Terms and Conditions 

1. Scope of application
 

The following conditions are accepted by both: Andreas Steiner, Owner oft he registered company Steiner Superiormallets (e.U.) and the customer as constituting part of the contract. Any agreements reached deviating from these conditions are only valid if made in writing and signed by all parties.

2. Formation of the contract and withdrawal from the contract 

The contract takes effect upon acceptance of the order by Andreas Steiner, owner oft he registered company Steiner superiormallets. All specifications with regard to products, publications, etc. are subject to alteration unless expressly referred to as binding. 

a) Steiner superiormallets, represented by Andreas Steiner, is entitled to withdraw from the contract in the case of: 
o acts of God or any other circumstances for which it cannot accept responsibility, resulting in it being unable to dispatch the goods; 
o non-payment within a period of 14 days beyond the agreed deadline, or failure to observe a subsequently agreed deadline extension. 

b) The customer is entitled to withdraw from the contract in the case of: o intentional or negligent conduct on the part of Steiner superiormallets resulting in non-dispatch of ordered goods. The legal rights of withdrawal from the contract remain hereby unaffected. 

c) In case of withdrawal from the contract, Steiner superiormallets and the customer are obliged to return or compensate for any goods, payments or services already provided in connection with that contract. Depreciation of the value of the goods concerned is to be taken into consideration. 

3. Payment and time for payment, default 

All prices are quoted as net-prices but also inclusive 20 % of austrian value added tax (VAT). Postage and packing (shipping and packing costs) will be charged separately according the terms of delivery. Goods can be paid for by bank transfer within 14 days of receipt. The customer shall be considered to be in arrears after receipt of a written payment demand or automatically 30 days after receipt of the goods in question. Should the customer fall into arrears, Steiner superiormallets is entitled to levy interest at a rate of 5% p.a. in excess of the current basic rate of interest of the Austrian Federal Bank. In the case of first-time customers, dispatch occurs after receipt of payment. 

4. Reservation of proprietary rights 

All goods remain the property of Steiner superiormallets until payment in full. During this time, goods may not be sold, hired out, lent or otherwise disposed of. Repairs by any third party will invalidate the guarantee. In the case of theft or any other circumstances resulting in the negation of any of Steiner superiormallets’ rights during the guarantee period, the customer shall inform the owner, Andreas Steiner, immediately. During the guarantee period or any period during which the customer is in possession of goods for which he has not yet paid in full, he shall be liable to compensate Steiner superiormallets in all cases of damage or loss. In case of breach of contract on the part of the customer, in particular delayed payment, Andreas Steiner, owner of Steiner superiormallets, is entitled to take repossession of the goods in question, without prejudice to all other rights and claims of Steiner superiormallets.

5. Liability for defects 

If a warrenty case is established, the purchaser can demand subsequent the performance. Steiner superiormallets is entitled to repair, replace or refund the purchase price. Complained deliveries will only be taken back if the material is still in the same condition as when delivered.

 Steiner superiormallets is neither directly nor indirectly liable for: damages, financial losses, claim for damages by third parties, etc., which results from the use oft he delivered goods. Claims for damages due to wrong, defective or delayed deliveries are excluded. The products offered bs Steiner superiormallets are made by hand and therefore specified weight and dimensions must be accorded a tolerance which may exeed the limit for machine-made products. 

The manufacturer pays particular attention to the equivalence of weight and dimension in pairs (tolerance +/- 1 gram and 1 mm) and to comply (within acceptable limits) with the technical data given for the inividual mallet models shown on the website: www.mallets.at. In the case of complaints which are not plausible in the basics oft he above statements, Steiner superiormallets assumes no liability and is not abliged to bear any costs or to allow discounts involved in a re-order. 

6. Delivery conditions 

The risk in the goods passes to the customer at the time of dispatch. Information regarding delivery times is estimated only, unless specifically agreed in writing. Unless otherwise stated in the order confirmation, dispatch shall be made from the company address of Steiner superiormallets.

7. Right of lien 

Andreas Steiner, owner of Steiner superiormallets has a right of lien on those goods manufactured or repaired by it, in connection with the fulfillment of its contractual rights. 

8. Place of jurisdiction and applicable law

 All claims arising from the contract shall be deemed to have arisen in Salzburg, Republic of Austria, and shall be determined according to federal Austrian law. Place of jurisdiction is Salzburg, Austria. 

9. Salvatorius clause

In the event of any of the above clauses being determined to be unenforceable, such determination shall not adversely affect the remaining terms.
